1. Agreement to Terms

By accessing or using the Vagabound Books website (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site. We may revise these Terms at any time by updating this page; continued use constitutes acceptance of the revised Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in any way that causes, or may cause, damage to the Site or impairment of availability or accessibility.
• Use the Site in any way that is unlawful, fraudulent, or harmful.
• Transmit any malware, spyware, viruses, or other malicious code.
• Attempt to gain unauthorized access to the Site, server, or database.
• Scrape, data-mine, or systematically collect content without our written consent.

3. Account Registration

To make a purchase, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our sole discretion.

4. Orders & Payment

All orders are subject to acceptance and availability. Prices are listed in USD and are subject to change without notice. Payment must be received before orders are shipped. We accept the payment methods displayed at checkout. You represent and warrant that you have the legal right to use any payment method submitted.

We reserve the right to refuse or cancel any order for reasons including product availability, errors in pricing or product descriptions, or suspected fraud.

5. Shipping & Delivery

Shipping costs and estimated delivery times are provided at checkout. We ship to the address you provide; you are responsible for ensuring the address is accurate. Risk of loss and title for items pass to you upon delivery to the carrier.

We are not responsible for delays caused by carriers, customs, or events outside our reasonable control.

6. Returns & Refunds

All sales are final unless the item is damaged in transit or not as described. If you receive a damaged or incorrect item, contact us within 7 days of delivery with photos and your order number. We will arrange a replacement or refund at our discretion.

Refunds are processed to the original payment method and may take 5–10 business days to appear.

7. Product Descriptions

We describe each book as plainly and accurately as possible, including condition notes. However, we do not warrant that product descriptions or other content on the Site are complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Vagabound Books or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Third-Party Links

The Site may contain links to third-party websites (e.g., Bookshop.org, Instagram). These links are provided for your convenience only. We have no control over, and assume no responsibility for, the content or practices of any linked site.

10. Disclaimer of Warranties

The Site and all products are provided “as is” and “as available” without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Vagabound Books shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or in connection with your use of the Site or products purchased.

Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the product or service giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vagabound Books and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, violation of these Terms, or infringement of any third-party right.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Allegheny County, Pennsylvania.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vagabound Books regarding your use of the Site and supersede all prior agreements, understandings, or representations.
